About the assessment
ChatGPT is closed-source and hosted in the US on Microsoft Azure. There is no option for self-hosting or end-to-end encryption, so OpenAI can access all conversations on its servers. By default, conversations are used to train future models. You can opt out to prevent new data from being used, but this does not affect data already used for training. OpenAI's Trust Portal lists SOC 2 Type II and ISO 27001/27701/42001 certifications, but these mainly apply to Enterprise and API customers, not the free or lower-cost tiers most people use. Since February 2026, in-chat ads have appeared in the free and Go tiers, alongside subscriptions ranging from $20 to $200. This creates greater incentive to monetize data, especially after a $13 billion investment from Microsoft and a for-profit restructuring in October 2025 that strengthened OpenAI's ties to Big Tech.

OpenAI encrypts ChatGPT data at rest using AES-256 and in transit using TLS. There is no end-to-end encryption of conversations: OpenAI's systems can access message content server-side, which the company says is necessary for abuse and safety monitoring. OpenAI's privacy policy discloses sharing data with vendors, service providers, corporate affiliates (including Microsoft), successors in a business transfer, and law enforcement when legally required. The US policy also allows sharing limited data with marketing partners, subject to an opt-out, which goes beyond processors needed to run the service. No public evidence of outright data sales was found, but the sharing scope exceeds a strictly necessary processor model.

OpenAI may use the Free, Plus, and Pro conversation sessions to help improve its models, unless the user turns off the option "Improve the model for everyone" in Data Controls. This opt-out option is easy to find and has no effect on the service. However, it is not retroactive; any conversations already used for training will still be part of previous training runs.
